Time to introduce Liberty Protection Safeguards

Date: 11-10-2017 Ref: News 11/2017

The current Deprivation of Liberty Safeguards (DoLS) are “an administrative and bureaucratic nightmare” according to the Law Commission. Anne Taylor, Thorngate Living’s CEO, examines the present system and the asks when the new and improved Liberty Protection Safeguards (LPS) are going to be introduced.

In the latest post on her Blog, Anne Taylor looks at how the current DoLS, whilst well-intentioned, are no longer fit-for-purpose and summarises the impact of the ‘Cheshire West’ judgement on an already over-burdened care sector.

The Law Commission, has proposed replacing the complete system with new Liberty Protection Safeguards (LPS) and, following extensive consultation, has drafted a bill and concluded its work. Anne asks whether we should allow Brexit to dominate parliamentary time to the extent that such important new legislation is left gathering dust on a shelf, rather than being debated and implemented?
